RIGHT OF WITHDRAWAL

If you are a consumer, you have the right to withdraw from your order, without giving any reason, within 14 days from the day you received the product you ordered (or the last product, batch or piece in the case of goods, batches or multiple pieces delivered separately). If you have appointed a person you trust to collect the product, your right of withdrawal begins on the day the product is delivered to the person you have appointed, other than the courier.
You will have to inform La Sicilia in Bocca di Peraino Bartolomeo, at its registered office in Erice, Via Vittorio Emanuele, 61, VAT no. 01860030814, of the exercise of the right of withdrawal by sending us a registered letter with return receipt together with a copy of the ORDER CONFIRMATION and/or SHIPPING NOTICE you have received, as well as a precise indication of the good(s) for which you intend to exercise the right of withdrawal. You will be contacted by phone or email for confirmation.
If you prefer to exercise your right of withdrawal by email to lasiciliainboccaerice@gmail.com, you may do so! Remember, however, to always enclose a copy of the ORDER CONFIRMATION or SHIPMENT NOTICE that you received and to indicate the good(s) for which you intend to exercise the right of withdrawal. The email must in any case be followed by the sending of a registered letter with return receipt within the next 48 hours.
In order to be able to exercise the right of withdrawal, it is necessary that the relative communication be sent before the expiration of the 14-day period and that the product be returned within the terms of the law, undamaged and without alterations and tampering, to La Sicilia in Bocca di Peraino Bartolomeo at its registered office in Erice, Via Vittorio Emanuele, 61, VAT no. 01860030814. Inside the package you will send us, you must enclose the SHIPPING NOTICE on which you must write clearly and in red colour the wording "RETURN EX ART. 52 D.LGS. 6 SETTEMBRE 2005, N° 206".
You will be reimbursed the purchase price of the product for which you have exercised your right of withdrawal, excluding shipping costs for the method you have chosen and any surcharges due depending on the payment system you have chosen (e.g. cash on delivery), within 14 days from the time we have received the goods at our premises. We will make the refund using the same payment method you used to place the order, or alternatively to the payment method indicated by you, where possible. We reserve the right, however, to make the refund by sending a bank draft payable to you.
Please note that you must return the products to us within 14 days from the day you communicated your withdrawal, the costs inherent in the return being borne by La Sicilia in Bocca di Peraino Bartolomeo. You may be held liable for any decrease in the value of the goods resulting from the handling and shipment of the same.
The right of withdrawal is limited only to customers who are consumers within the meaning of the Consumer Code (Legislative Decree, 06/09/2005 no. 206). If, on the other hand, you have requested that the goods be invoiced to the VAT number of which you are the holder, we will not be able to ensure the right of withdrawal.

EXCEPTIONS

The right of withdrawal does not apply in the case of
  • supply of sealed goods that are not suitable to be returned for hygienic or health protection reasons and that have been opened after delivery or in case of supply of goods that are, after delivery, inseparably mixed with other goods or whose original packaging has been damaged to such an extent that it is not possible to return them for sale
  • supply of goods that are liable to deteriorate or expire rapidly;
  • service contracts after full performance of the service by La Sicilia in Bocca di Peraino Bartolomeo, if you have expressly consented to the performance of the service by us accepting the loss of the right of withdrawal following full performance of the contract
  • contracts relating to the supply of goods and services to VAT-registered persons.
